Terms of Business

Definitions
- Customer / you: the person or company who requests or accepts our services.
- Consumer: a Customer who is an individual acting for purposes outside their trade, business or profession.
- Services: the plumbing, heating, ventilation, air-conditioning, plant-room, maintenance or other mechanical works we agree to carry out.
- Quotation: our written offer to provide the Services.
- Contract: the agreement between us formed when you accept our Quotation in writing (including email) or when we begin work at your request.
- Materials: goods, equipment, fixtures and fittings supplied by us as part of the Services.
Quotations and Formation of Contract
2.1 Quotations are valid for 30 days from the date of issue unless stated otherwise and are subject to survey and final confirmation.
2.2 A Quotation is an invitation to treat and does not form a binding contract until accepted by you and confirmed by us.
2.3 Any drawings, specifications or estimates of materials are approximate unless stated as fixed.
2.4 We reserve the right to amend a Quotation if site conditions differ from those assumed or if you request changes.
Scope of Services
3.1 We will carry out the Services with reasonable care and skill in accordance with good industry practice and, where applicable, Gas Safe Register requirements, Building Regulations and manufacturer instructions.
3.2 All gas work will be undertaken by Gas Safe registered engineers.
3.3 We will use materials of satisfactory quality that are fit for purpose. Where specific brands or models are quoted we will use those or suitable equivalents of equivalent or better quality if the original becomes unavailable.
3.4 Unless expressly included in the Quotation, the following are excluded: structural work, electrical work beyond isolation/reconnection of heating controls, decoration, making good of plaster/decor beyond reasonable making-good of holes we create, asbestos surveys/removal, and any works required by third-party inspections or local-authority notices not known at quotation stage.
Customer Obligations
You agree to:
- Provide clear, safe and uninterrupted access to the property and work areas during agreed working hours.
- Ensure that water, electricity and gas supplies are available as required.
- Obtain any necessary planning permissions, landlord consents or listed-building consents.
- Inform us of any known hazards (including asbestos, structural issues or previous works).
- Move or protect furniture, flooring and valuables unless we have specifically agreed to do so.
- Make decisions and provide information promptly so as not to delay the works.
Failure to meet these obligations may result in additional charges or suspension of work.
Price and Payment
5.1 The price is as stated in the accepted Quotation (plus VAT at the prevailing rate).
5.2 Unless otherwise agreed in writing:
- A deposit may be required before work starts (typically 20–40 % depending on the value and materials).
- Interim payments may be requested on larger projects.
- The balance is due on practical completion or within 7 days of our invoice, whichever is earlier.
5.3 Payment is to be made by bank transfer to the account details on our invoice. We do not accept cash for sums over £500 without prior agreement.
5.4 Late payment attracts interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998 (or the statutory rate for Consumers). We may also suspend work or recover reasonable debt-collection costs.
5.5 Title to Materials remains with us until paid for in full. Risk passes to you on delivery to site.
Variations
Any change to the agreed scope must be confirmed in writing (including email or text). We will provide a revised price and timescale where possible before proceeding. Additional works carried out at your request will be charged at our standard rates plus materials.
Timescales
Any start or completion dates given are estimates only. We will use reasonable endeavours to meet them but are not liable for delays caused by circumstances beyond our reasonable control (including supply shortages, adverse weather, Customer delays, or third-party issues).
Guarantees and Warranties
8.1 We guarantee our workmanship for 12 months from the date of practical completion.
8.2 Manufacturer guarantees on boilers, cylinders, controls and other equipment are passed on to you and remain subject to the manufacturer’s terms (registration, servicing, etc.).
8.3 The workmanship guarantee does not cover fair wear and tear, misuse, lack of maintenance, failure to service, or work carried out by others.
8.4 For Consumers, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose and as described; services must be performed with reasonable care and skill).
Cancellation Rights (Consumers only)
9.1 If the Contract is concluded away from our premises or by distance means (telephone, email, website), you have the right to cancel within 14 days of the Contract being formed under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
9.2 To cancel you must inform us in writing (email is acceptable).
9.3 If you request that work begins during the cancellation period and then cancel, you must pay for the value of the Services and Materials supplied up to the point of cancellation.
9.4 Once work has been fully completed you lose the right to cancel.
Liability and Insurance
10.1 We maintain public liability and employers’ liability insurance at levels appropriate to our business. Details are available on request.
10.2 Our total liability under the Contract (whether in contract, tort or otherwise) is limited to the total price paid or payable under the Contract, except in cases of death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.
10.3 We are not liable for:
- Indirect or consequential loss (including loss of profit, business interruption or loss of use).
- Damage to decorations, flooring or structures that is a reasonable consequence of the works (we will make good holes we create to a reasonable standard).
- Pre-existing defects or problems we could not reasonably have discovered.
- Failure of systems or components caused by inadequate water quality, sludge, or lack of inhibitor/maintenance by the Customer.
Health & Safety and Gas Safety
We will comply with all relevant health and safety legislation. You must not interfere with any safety devices or instructions we leave. All gas appliances and installations will be left in a safe condition and, where required, notified to Gas Safe Register / Building Control.
Termination
Either party may terminate the Contract by written notice if the other commits a material breach and fails to remedy it within 14 days (or immediately in the case of insolvency). On termination you must pay for all Services and Materials supplied up to the termination date.13. You also have the right to refer certain complaints to the relevant ombudsman or Trading Standards if applicable.
Data Protection
We process personal data in accordance with our Privacy Policy (available on our website). By entering into a Contract you acknowledge that we will process necessary data to perform the Services and meet legal obligations (including Gas Safe records).
General
15.1 These terms constitute the entire agreement between us and supersede any previous discussions or representations.
15.2 If any provision is found to be invalid the remaining provisions continue in full force.
15.3 No waiver of any breach is a waiver of any subsequent breach.
15.4 We may subcontract elements of the work but remain responsible for overall performance.
15.5 These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction (subject to any mandatory Consumer protections).
